From offer to first day: onboarding without a visit to the office

When someone accepts an offer, you send the contract, declarations and policy in one set. The person opens the link on a phone, fills in their details in the template and signs with a finger. They do not create an account, so nothing blocks them, even if they have never used a tool like this before.

If the employee should sign first and the employer second, you set the signatures in a fixed order: the next person receives the document only after the previous one has signed. Employment contracts, amendments and foreign nationals: what to check

This is a summary of legal opinions, not legal advice. An employment contract requires written form (Art. 29 § 2 of the Polish Labour Code). According to the legal opinion of 21 August 2023 a handwritten signature from SignSafe preserves that form. Before the employee is allowed to start work, however, the employer should confirm the contract and its terms to the employee in writing.

Legal information from the law firm Gałecki and Associates from 2021 sees no obstacle to concluding employment and civil-law contracts with foreign nationals whose status is equal to that of Polish citizens as regards the right to work. It requires a translation of the contract into a language the foreign national understands and notes that in work or residence permit proceedings and during labour inspectorate checks the authorities may read “written form” as a paper document. Employee records in electronic form

Storing employee records is a separate matter from signing the contract. According to a legal analysis prepared for SignSafe, archiving employee records in electronic form requires a digital copy bearing the employer’s qualified signature or qualified electronic seal. Many contracts at once: templates and bulk signing

If you use the same contract with many people, save it as a template with fields to fill in: the employee enters their own details (for example a PESEL number or an identifier, a date, text), and you do not retype them from messages. Someone who signs many documents selects them and signs them all at once. We do not state a limit on the number of documents.

Legal nature of a signature placed by hand on the touch screen of an electronic device

A signature placed in SignSafe is a handwritten signature, and a declaration of intent signed in the app meets the requirements of written form. If the signature did not qualify as handwritten, the declaration is still valid in documentary form. In legal effect it is equivalent to a qualified electronic signature: both preserve written form.

Legal note: concluding employment and civil-law contracts with foreigners through the SignSafe app

There are no obstacles to concluding employment and civil-law contracts through SignSafe with Polish citizens and with foreigners whose status is equal as regards the right to work: the signature has the features of a handwritten signature and meets written form. Caveats: the employer should confirm in writing to the employee the fact of the contract and its terms before the employee starts work; authorities (work or residence permits, labour inspections) may read written form as a paper document; a foreigner must be given a translation of the contract.
