Which property documents you can sign in SignSafe

The form of a brokerage agreement: what the legal opinion says

A brokerage agreement in real property transactions requires written or electronic form on pain of nullity (Art. 180(3) of the Real Estate Management Act). According to a legal opinion from Gałecki and Associates dated 18 July 2024, an agreement concluded by the parties in SignSafe meets the requirements of that form.

This builds on the firm’s other opinion of 21 August 2023: a SignSafe signature is a handwritten signature, and a declaration of intent signed in the app meets the written form requirement (Art. 78 of the Civil Code). Where a qualified electronic signature is needed, we can connect one in SignSafe. SignSafe does not replace a notarial deed, so contracts transferring ownership of property are still concluded at a notary.

An agent’s day with e-signature

After a viewing, the client says they want to reserve the flat but they are about to board a train. You send a reservation agreement from a template. Before they arrive, they open the link on their phone, fill in the details and sign.

Another client lives abroad and is buying to let. Instead of a courier and several days of waiting, they get a link and sign the brokerage agreement wherever they are. You still see what stage the document is at.

Security and legal basis

A SignSafe signature is a handwritten signature and, according to a legal opinion from Gałecki and Associates dated 21 August 2023, meets the written form requirement (Art. 78 of the Civil Code); at the least, the declaration is valid in documentary form (Art. 77² of the Civil Code). It is not a qualified electronic signature, but where a qualified electronic signature is required (the electronic form under Art. 78¹ of the Civil Code), we can connect one in SignSafe. SignSafe does not support notarial deeds.
