A freelancer’s project from contract to invoice with e-signature

A client writes that they want to start on Monday. On Friday after a call you send them the contract from a template, and they sign it on the tram on their phone. You do not wait for a printout and a scan, so the project starts with a signed scope of work.

During the work the client asks for an extra feature. You send a short annex with the new scope and deadline, and they sign it the same way. Both sides know what was agreed.

Freelancers typically sign contracts for specific work, commissions, acceptance protocols and consents. According to a legal opinion from Gałecki and Associates dated 21 August 2023, a SignSafe signature is a handwritten signature, and a declaration of intent signed in the app meets the written form requirement (Art. 78 of the Civil Code). If the signature failed to meet the handwriting requirement, the declaration is valid in documentary form (Art. 77² of the Civil Code).
